These Terms of Service ("Terms") govern your use of the Aurum platform provided by [COMPANY_NAME] (Pty) Ltd. By accessing or using Aurum, you agree to these Terms. These Terms comply with the Electronic Communications and Transactions Act 25 of 2002 (ECTA), Section 43.

2. Service Description

Aurum is a QR-code-based ordering platform for hospitality and gaming venues. The platform enables:

• Anonymous guest ordering via QR code scanning — no app download required.
• Staff management dashboards for order processing, kitchen display, and delivery tracking.
• Venue administration including menu management, analytics, and promotions.

Aurum is a B2B software-as-a-service (SaaS) product. Our clients are casino and hospitality operators. Guests interact with the ordering interface but do not have accounts or contractual relationships with us.

3. Pricing and Payment

All prices displayed on our website are in South African Rand (ZAR) and are inclusive of 15% VAT where applicable.

• Trial: Free for 14 days, no credit card required.
• Starter: R4,999/month (incl. VAT) or R49,990/year.
• Professional: R12,999/month (incl. VAT) or R129,990/year.
• Enterprise: From R35,000/month — custom pricing.

Payment is accepted via bank transfer (EFT) and credit/debit card. Invoices are issued monthly in advance.

4. Subscription Terms

• Subscriptions are billed monthly or annually as selected.
• Annual subscriptions are discounted and billed upfront.
• Monthly subscriptions auto-renew at the end of each billing cycle unless cancelled.
• You may cancel at any time by contacting us at [EMAIL]. Cancellation takes effect at the end of the current billing period.
• No partial refunds for unused portions of monthly billing periods.

5. Cooling-Off Period and Refunds

In accordance with ECTA Section 44:

• You may cancel your subscription within 7 days of initial purchase without reason and receive a full refund.
• Refunds will be processed within 30 days of receiving your cancellation notice.

6. Order Fulfilment

Per ECTA Section 46, service activation occurs within 24 hours of payment confirmation, unless otherwise agreed. If we cannot activate your account within 30 days, you are entitled to a full refund.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose.
• Attempt to access other users' accounts or data.
• Interfere with the operation of the platform or its infrastructure.
• Upload malicious code or content.
• Resell or sublicense access without written permission.

8. Intellectual Property

All intellectual property in the Aurum platform (code, design, trademarks) belongs to [COMPANY_NAME] (Pty) Ltd. Your subscription grants a non-exclusive, non-transferable licence to use the platform for your business operations.

Content you upload (menus, images, branding) remains your property. You grant us a licence to display and process it as needed to provide the service.

9. Limitation of Liability

• Aurum is provided "as is". We do not guarantee uninterrupted or error-free operation.
• Our total liability is limited to the fees you paid in the 12 months preceding the claim.
• We are not liable for indirect, consequential, or incidental damages including lost revenue or data.
• We are not responsible for the quality, safety, or legality of food/beverages ordered through the platform — that responsibility lies with the venue operator.

11. Complaints and Disputes

If you have a complaint:

• Contact us first at [EMAIL]. We will acknowledge within 5 business days and aim to resolve within 30 days.
• If unresolved, you may refer the matter to arbitration under the Arbitration Act 42 of 1965.
• For consumer complaints, you may also contact the National Consumer Commission.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email. Continued use after the effective date constitutes acceptance.
